Environmental and Tourism Balance: Supreme Court Allows Limited Use of Sisodia Rani ka Bagh for Events, Imposes Strict Noise and Pollution Controls

Environmental and Tourism Balance: Supreme Court Allows Limited Use of Sisodia Rani ka Bagh for Events, Imposes Strict Noise and Pollution Controls

Case Name: Director, Department of Archaeology and Museums, Jaipur & Ors. v. Ashish Gautam & Ors.

Citation: 2020 INSC 394

Date of Judgment/Order: 11 May 2020

Bench: Arun Mishra, S. Ravindra Bhat

Held: The Supreme Court allowed the partial appeal, permitting the Sisodia Rani ka Bagh to host events between 8 AM and 8 PM, subject to strict restrictions on noise, fireworks, and pollution to protect the wildlife and heritage value of the monument.

Summary: The appellants, Department of Archaeology and Museums, challenged the National Green Tribunal’s order which imposed a blanket ban on events at Sisodia Rani ka Bagh, a protected monument in Jaipur, arguing that such a restriction would negatively affect tourism and state revenue. The Respondent, Ashish Gautam, had filed a Public Interest Litigation concerning environmental hazards, requesting restrictions on noise, fireworks, and laser lights.

The Supreme Court examined the environmental and heritage significance of the Sisodia Rani ka Bagh and noted its importance for tourism in Jaipur. However, the Court upheld certain restrictions on events held in the monument, emphasizing the need to protect the wildlife in the adjacent forest area. The Court ruled that the monument could be used for appropriate multi-purpose activities, but only between 8 AM and 8 PM, to limit any negative environmental impact.

The Court specifically prohibited the use of laser lights, loud music, and fireworks, recognizing their potential to disturb wildlife. It also directed the authorities to appoint a consultant for further beautification and development of the site, focusing on sustainable tourism that preserves both the environment and the historical heritage of the area.

Decision: The appeal was allowed in part. The Supreme Court modified the National Green Tribunal’s order, permitting the monument to host appropriate events within restricted hours. Strict compliance with noise and pollution control measures was mandated. The Court directed the State to submit a report within a month on the progress of the beautification plan.
