No Right to Personal Hearing Before Fraud Classification Under RBI Directions: Supreme Court Clarifies Scope of Natural Justice

Held: The Supreme Court held that borrowers do not have a vested right to a personal or oral hearing before classification of their accounts as “fraud” under RBI Master Directions. Compliance with principles of natural justice is satisfied by issuance of a detailed show cause notice, furnishing relevant material (including conclusions of forensic audit), consideration of the borrower’s written reply, and passing of a reasoned order.

Summary: The dispute arose from challenges to bank decisions classifying borrower accounts as “fraud” under RBI Master Directions, where High Courts had mandated personal hearing and supply of full forensic audit reports. The Supreme Court examined whether its earlier judgment in State Bank of India v. Rajesh Agarwal (2023) required oral hearing. The Court clarified that Rajesh Agarwal only read the principles of natural justice into the RBI framework and did not mandate a personal hearing. It emphasized that natural justice is a flexible concept and its application depends on the nature of the administrative process. Relying on settled precedents, the Court held that opportunity to be heard does not necessarily mean oral hearing, and written representation can sufficiently meet fairness requirements. The Court also highlighted that fraud classification is largely based on documentary evidence and is an internal administrative decision aimed at prompt detection and reporting of financial frauds. It noted that requiring personal hearings in every case would delay the process, burden banking operations, and risk dissipation of assets, thereby prejudicing public interest.

Decision: The appeals were allowed; the High Court judgments mandating personal hearing and full forensic audit disclosure were set aside. The Supreme Court upheld the validity of the RBI framework and clarified that written opportunity and reasoned decision satisfy natural justice requirements.
