False Scheduled Tribe Claims Through Dubious Caste Certificates Amount to Serious Misconduct, Though Criminal Proceedings May Be Quashed in Exceptional Humanitarian Circumstances

Held: The Supreme Court held that a person attempting to wrongfully appropriate reservation benefits meant for Scheduled Tribes through dubious caste certificates commits a serious illegality and effectively deprives genuine candidates of constitutionally protected benefits. The Court observed that ordinarily such conduct would not deserve judicial indulgence. However, considering the peculiar humanitarian circumstances of the case, including the appellant’s advanced age, retirement from service, personal tragedies, and the fact that he had not ultimately obtained any benefit from the disputed Scheduled Tribe claim, the Court exercised its extraordinary jurisdiction to quash the pending criminal proceedings. The Court nevertheless made it expressly clear that the disputed caste certificate relied upon by the appellant was invalid and could not form the basis for any future parity claims.

Summary: The appellant, an engineer employed first in the Central Public Works Department and later in the Uttar Pradesh State Service, had originally entered service in 1984 by availing reservation benefits as a member of the “Mallah” backward class community. In 1993, nearly nine years after joining service, the appellant produced a caste certificate claiming that he belonged to the “Majhwar” community notified as a Scheduled Tribe under Article 342 of the Constitution. Though the claim was initially accepted, a subsequent enquiry conducted by the Tehsildar, Kalpi, District Jalaun revealed that the alleged certificate did not bear any official serial number and had not in fact been issued from the concerned office. An FIR was thereafter registered in 2004 alleging use of a forged caste certificate. The appellant’s attempt to quash the proceedings under Section 482 CrPC failed before the High Court. Before the Supreme Court, the appellant again attempted to assert his tribal status, but the Court found the certificate inherently unreliable, particularly because it did not even disclose the date of issuance and stood contradicted by the Tehsildar’s report. The Court also noted that the appellant had originally sought appointment only under the backward class category and had never asserted Scheduled Tribe status at the time of entering service, thereby undermining the credibility of his later claim.

Decision: The Supreme Court allowed the appeal and quashed Charge-sheet No. 3 of 2006 as well as Criminal Case No. 2213 of 2006 pending before the Additional Chief Judicial Magistrate, Jalaun at Orai. The Court directed closure of the criminal proceedings solely in view of the peculiar facts and humanitarian considerations surrounding the appellant, including his advanced age, retirement, and personal circumstances. At the same time, the Court categorically declared that the caste certificate relied upon by the appellant was invalid and clarified that no person could claim parity or derive any legal benefit on the basis of that certificate. Pending applications stood disposed of.
