A Hindu Widow’s Property Right Cannot Be Denied Merely Because She Never Sought Partition, Holds Supreme Court

A Hindu Widow’s Property Right Cannot Be Denied Merely Because She Never Sought Partition, Holds Supreme Court

Case Name: Ganapati (Dead) by His LRs v. Prabhakar & Others

Date of Judgment: 22 September 2026

Citation: 2026 INSC 1033

Bench: S.V.N. Bhatti and N.V. Anjaria, JJ.

Held: A widow who acquired her husband’s interest under Section 3 of the Hindu Women’s Rights to Property Act, 1937, need not first seek partition for that interest to become absolute under Section 14(1) of the Hindu Succession Act, 1956. Failure to prove an alleged oral partition does not extinguish the right that vested in her by law.

Summary: Gangaram died in 1949, leaving his son Ganapati and widow Kashibai. Ganapati claimed exclusive ownership of two house properties and challenged Kashibai’s will in favour of her daughter, as well as the daughter’s subsequent sale of one property. The trial court and first appellate court accepted his claim, reasoning that Kashibai had never sought partition and therefore had no disposable title. The High Court reversed those findings. Upholding the High Court, the Supreme Court held that Kashibai’s statutory interest in her husband’s property was not conditional on partition. Section 14(1) enlarged her limited interest into absolute ownership; the unproved oral partition did not defeat that conclusion. The Court also found the High Court’s intervention in second appeal consistent with Section 100 of the Code of Civil Procedure, 1908.

Decision: The son’s legal representatives’ civil appeal was dismissed. The High Court judgment allowing the second appeal stood affirmed.
