Nevertheless, since Accused Nos. 2 and 3 were caught transporting the deceased’s body on a motorcycle while attempting to dispose of it, their conviction under Section 201 read with Section 34 IPC was rightly sustained.
Decision: The Supreme Court dismissed the appeals filed by the State of Maharashtra and upheld the High Court’s judgment. It confirmed the acquittal of all accused for offences under Sections 302 and 120B IPC while affirming the conviction of Accused Nos. 2 and 3 under Section 201 read with Section 34 IPC for causing the disappearance of evidence.
