Case Name: Union of India and Others v. Sunil Kumar Rai and Others
Citation: 2026 INSC 311
Date of Judgment/Order: 01 April 2026
Bench: Hon’ble Mr. Justice Pankaj Mithal; Hon’ble Mr. Justice S.V.N. Bhatti
Held: The Supreme Court held that Junior Engineers are entitled to Non-Functional Upgradation (NFU) to Level 9 upon completion of four years of service in Level 8 under Para 7.4.13(iv)(b) of the Seventh Central Pay Commission, and that denial of such benefit based on entry-level grade pay is impermissible as it introduces conditions not contemplated by the recommendation.
Summary: The dispute arose from denial of NFU benefit to Junior Engineers in the Border Roads Organisation, who had reached Level 8 (Grade Pay ₹4,800) through MACP and completed four years of service at that level. The respondents relied on Para 7.4.13(iv)(b) of the Seventh Central Pay Commission, which provides that 80% of employees in Level 8 shall be eligible for NFU to Level 9 after four years on a seniority-cum-suitability basis. The Union of India contended that NFU was applicable only to those whose entry-level grade pay was ₹4,800 and not to those who reached that level through financial upgradation. The High Court rejected this contention, holding that the mode of entry into Level 8 is irrelevant and that the only requirement is completion of four years at that level. The Supreme Court affirmed this reasoning, observing that reading an “entry-level” condition into the provision would amount to adding a restriction not present in the Pay Commission recommendations. It further noted that similar claims had been upheld in prior decisions and that denial of NFU to Junior Engineers, while granting it to other cadres, was unjustified.
Decision: The Supreme Court dismissed the appeal filed by the Union of India, upheld the High Court’s direction granting NFU to the respondents, and confirmed that Junior Engineers who have completed four years in Level 8 are entitled to Level 9 upgradation, with no order as to costs.
